Rules
1) Eligibility: To participate, you must be a student at a New York City public high school. Contest offered only in New York City. By participating, participants agree to be bound by these Official Rules. The NetAid and Cable Positive HIV/AIDS Video Contest commences at 12:01 a.m. EST on December 1, 2006, and ends at 11:59 p.m. EST on April 15, 2007. The Contest is run by NetAid in conjunction with Cable Positive (collectively referred to as "Agency") and sponsored by The New York City AIDS Fund of The New York Community Trust, The Design Industries Foundation Fighting AIDS, and Council of Fashion Designers of America, (collectively referred to as "Sponsor"). Employees, independent contractors, officers and directors of Sponsor or Agency, their affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and legal advisors, and the immediate family members and persons living in the same household of such persons are not eligible to participate in the Contest.
(2) How to Enter: Register your team using the online registration form and submit your entry online via YouTube by 11:59 p.m. on April 15, 2007. Alternately, you may mail it to NetAid and Cable Positive HIV/AIDS Video Contest c/o NetAid, 75 Broad Street, Ste. 2410, New York, NY 10004.
Participants should create their own Public Service Announcement ("PSA") videos to raise awareness among young people about the HIV/AIDS pandemic and to inspire them to take concrete actions to combat this disease on a local and global level. PSA entries may be any format including, but not limited to, video/film, animation, or claymation. Participants may upload video submissions to YouTube using any of the following formats: QuickTime .MOV, Windows .AVI, or .MPG files. YouTube recommends the MPEG4 (Divx, Xvid) format at 320x240 resolution with MP3 audio for optimal quality. Videos may be submitted via postal mail in the following media formats: ½" VHS, miniDV, or DVD. PSA entries must not exceed 30 seconds in length.
Participants must be the sole author and copyright owner of entry or must have permission (via license or otherwise) to use or incorporate portions of their entry authored, owned or controlled by third parties. Neither Agency nor Sponsor are responsible for late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries, none of which will be considered. All entries must include a fully signed, original copy of the Terms & Conditions for submission.
(3) Prizes: The winning PSA team will receive in-person training and production from Cable Positive to turn their winning video entry into a professional video. The professional video will then be shown on NetAid and Cable Positive's respective websites and be submitted for screening at various venues (time and placement of all airings shall be at the sole discretion of Agency). The Honorable Mentions and People's Choice Winner will be featured on NetAid's and Cable Positive's respective websites and in various communications to its members (all such placements shall be at the sole discretion of Agency). Accepting the prize constitutes permission (except where prohibited by law) to use winner's name, hometown (including state) and/or likeness for promotional purposes without further compensation. Prize(s) is non-transferable and may not be substituted for another prize, except NetAid and Cable Positive may award prize of equal or greater value if prize becomes unavailable or for whatever reason.
(4) Judging: Initial Judging: Once all entries are received, NetAid and Cable Positive will narrow the field to ten (10) semifinalists. Final Judging: A panel of judges will review each of the ten (10) video semifinalists and decide upon the contest winners, based upon the criteria below. The semifinalists will then be judged by a distinguished panel of five judges, including Sunita Mehta of Funders Concerned with AIDS, Bari Zahn of Living Beyond Belief along with staff members from NetAid and Cable Positive. The judges' decision is final.
PSA judging for both the semifinals and finals will be based on four equally weighted criteria:
- Innovation and Creativity: setting, tone and style of PSA (weighted 25%)
- Message: clarity and effectiveness in incorporating key messages about HIV/AIDS (weighted 25%)
- Resonance: youth appeal and responsiveness (weighted 25%)
- Action: effectiveness in engaging peers to get involved in the issue (weighted 25%)
Agency has the right to reject, at its sole discretion, any entry that it considers inappropriate, offensive, defamatory or demeaning to Agency’s reputation or goodwill. Winners will be notified by e-mail, overnight mail and/or phone in May 2007 and thereafter must complete an affidavit or declaration of eligibility/liability release and, except where prohibited, a publicity release and such other documents as may be reasonably required by Agency. Failure to return any prize notification or other required documents in a timely fashion may result in forfeiture of the prize and selection of the second place entrant as the winner. Agency assumes no responsibility for, and shall not be liable for, late, lost, misdirected or unsuccessful efforts to notify winners.
(5) By participating, entrants agree that Agency and Sponsor, their shareholders, agents and representatives, affiliates, subsidiaries, advertising, promotion and fulfillment agencies and legal advisors are not responsible or liable for, and shall be released and held harmless from: (i) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures or difficulties of any kind; (ii) any condition caused by events beyond the control of Sponsor that may cause the Contest to be disrupted or corrupted; (iii) any printing or typographical errors in any materials associated with the Contest; (iv) any and all losses, damages, rights, claims and actions of any kind in connection with or resulting from participation in the Contest, or acceptance of the prize, including without limitation, claims based on publicity rights, defamation or invasion of privacy.
Agency reserves the right, in its sole discretion, to cancel, terminate, modify, extend, or suspend the Contest should computer virus, bugs, non-authorized human intervention, fraud, or other causes beyond its control corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such case, judges may, at their discretion, select the winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Agency. Agency reserves the right, at its sole discretion, to disqualify any individual(s) it finds to be tampering with the entry process or the operation of the Contest or NetAid’s web site.
(6) Legal: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrant, Agency, and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of New York or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of New York. (7) Winners List/Official Rules: NetAid, Cable Positive staff and a judging panel will select and notify the winning team in April.
